Terms of Service
By creating an account or using the FitCheck mobile application ("FitCheck" or "the app") you agree to these Terms of Service. If you do not agree, do not use the app.
1. Eligibility
You must be at least 13 years old, or the local digital-consent age in your country, whichever is higher. By using the app you confirm you meet this requirement. If you are using the app in the European Economic Area, the United Kingdom, or another jurisdiction with a higher consent age, the local minimum applies.
2. Your account
- You are responsible for safeguarding your credentials and for any activity under your account.
- You are responsible for ensuring any photos you upload depict you, or a person who has given you permission to upload their image.
- You can delete your account at any time from Settings → Privacy & Data → Delete Account.
3. Acceptable use of photos
When you upload images, you confirm that:
- the photos do not depict a minor;
- the photos are not sexually explicit, violent, or designed to harass another person;
- the photos do not infringe any third party's intellectual-property, publicity, or privacy rights;
- you have the right to use any retailer or third-party clothing image you upload as a reference.
We may automatically refuse to process or remove content that violates these rules.
4. AI-generated content
- FitCheck uses AI services from Anthropic and Google to generate try-on images and from OpenAI to provide moderation, suggestions, and product classification. The list of AI processors and what we send them is documented in our Privacy Policy.
- AI-generated images are approximations, not guarantees that an item will fit, look, or be coloured exactly as shown when worn in real life. Purchasing decisions are your own.
- Every AI-generated image displayed in the app is labelled "AI-Generated". When you share an image with another user (in the community feed, via the share sheet, or by saving to your photo library), you must not represent it as an unedited photograph.
5. Community feed (user-generated content)
When you post to the community feed:
- We may run automatic moderation against your image. Posts that fail moderation will not be published. Posts may also be removed in response to user reports.
- You retain ownership of the images you post and grant FitCheck a worldwide, non-exclusive, royalty-free licence to host, display, and distribute the post inside the app for as long as you keep it published.
- You can delete any post at any time. Deleting a post removes it from the feed, but cached copies on other devices may persist briefly.
You agree not to post content that violates our Acceptable Use rules in section 3 or the App Store and Google Play developer policies governing user-generated content. Repeated violations can result in account suspension or termination.
You can report content that violates these rules from the "..." menu on any post, comment, profile, or AI result. You can block a user from the same menu to stop seeing their content. We aim to act on reports within 24 hours.
6. Tokens, subscriptions, and refunds
FitCheck offers two ways to pay, both processed by Apple In-App Purchase or Google Play Billing as appropriate to your platform:
- Token packs (
fitcheck_tokens_10,fitcheck_tokens_30,fitcheck_tokens_75) are consumable, one-time purchases. Each pack credits your account with the corresponding number of tokens; one token is consumed per AI try-on generation. Tokens never expire as long as your account exists, and unused tokens are non-transferable. - Because token packs are consumables (not subscriptions), there is nothing to cancel. If you do not want to be charged again, simply do not initiate another purchase.
- FitCheck Pro is an auto-renewing subscription offered as Monthly (
fitcheck_pro_monthly) or Annual (fitcheck_pro_annual). Pro grants a fixed token allowance each billing cycle (20 tokens/month on Monthly, 15 tokens/month on Annual) plus Pro-only features such as HD output, no watermark, priority generation, and price-drop alerts. Subscriptions renew automatically until cancelled at least 24 hours before the end of the current period via your Apple ID or Google Play account.
Pricing shown in the app is the price your platform store charges in your locale's currency. Refunds are handled by Apple or Google under their published policies; FitCheck cannot directly refund a store transaction. Consumable IAPs are generally non-refundable once the tokens have been spent, but Apple and Google may grant refunds at their discretion. To manage or cancel a Pro subscription use the in-app "Manage Subscription" link, which opens your platform's standard subscription settings.
7. Permitted use
You may not:
- reverse-engineer, decompile, or disassemble any part of the app;
- resell, sublicense, or commercialise FitCheck or its outputs in bulk;
- run automated clients, scrapers, or scripts that interact with the app or our APIs;
- attempt to circumvent rate limits, safety filters, content moderation, or payment requirements.
8. Disclaimers
The app and any AI outputs are provided "as is" and "as available" without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, FitCheck disclaims all such warranties.
9. Limitation of liability
To the maximum extent permitted by law, FitCheck and its operators shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for loss of profits, revenue, data, or goodwill. Our aggregate liability for any claim arising out of or relating to these Terms or the app is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 50.
10. Termination
You may terminate your account at any time from Settings → Privacy & Data → Delete Account. We may suspend or terminate your access to the app for material violation of these Terms (including violations of section 3 or 5) or to comply with law. On termination we will delete your data per the Privacy Policy.
11. Changes
We may update these Terms from time to time. For material changes we will post a notice in the app and update the "Last updated" date. Continued use of the app after a change constitutes acceptance.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws principles. Any dispute is subject to the exclusive jurisdiction of the courts of New South Wales, except where mandatory consumer law in your country of residence requires otherwise.
